The present Terms and Conditions define the procedure for use of software, interactive gambling activities (games) and other services provided by the organizing party at the website www.spelet.lv. The present Terms and Conditions also form the general agreement between the user and the organizer regarding the use of the aforesaid services.
In case the user has read these Terms and Conditions and does not agree with them (does not accept them), the user is not entitled to continue using the website www.spelet.lv, and immediately leave the said website. By continuing to use the website www.spelet.lv, the user confirms that he/she has fully read, understands, accepts and agrees to these terms.
The following terms and designations are used within the present Terms and Conditions:
Organizer - limited liability company (SIA) "NIKS", company registration No. 40003029864, legal address (registered office) Terbatas street 73, Riga, Latvia.
SPELET.LV - Organizer's website (web-page), where all the activities described in these Terms and Condition take place. Full website address: www.spelet.lv.
User - a natural person who has reached the age of 18 years and who creates a profile on the website SPELET.LV for the purpose of using the services provided by the Organizer.
Profile - account created by the User by registering on the website SPELET.LV. Only the User him/herself may perform any permitted actions with the Profile.
Inactive Profile - a profile in which no User activity, including logging-in or logging-out of it, has been detected for a period of more than 12 months.
Profile Deactivation - an activity or set of activities of the Organizer, as a result of which the User's right to use the Profile is restricted (the User can log in to his/her account and communicate with the Organizer, but cannot make Bets and/or make Deposits or Withdrawals).
Blocking of Profile - complete restriction of User's access to the account (the User cannot log in to his/her Profile).
Locking of Profile - deletion of User's Profile from the website SPELET.LV in accordance with the procedure specified in the Terms and Conditions.
Gambling - an interactive gambling activity (game), access to which is provided by the Organizer, and in which the User may receive (win) a prize by making a participation bet, which depends in whole or in part on the success event or circumstances that are previously unknown.
Bet - an amount of money that the User pays to the Organizer to participate in the Gambling on the website SPELET.LV.
Winnings - amount of money legally obtained (won) by the User, using the services provided by the Organizer fairly and in accordance with the present Terms and Conditions and rules of the relevant Gambling (game), which is not disputed by the Organizer and which the Organizer pays out to the User.
Deposit - the amount of money that the User transfers to the Organizer's current account, replenishing his/her Profile balance for making Bets.
Withdrawal - amount of money that the Organizer pays (disburses) to the User upon the request of the respective User and after performing all the necessary checks and verifications.
Special offers - all and any bonuses and promotions within which the User is offered a material benefit, including, but not limited to: special introductory offers, Gambling or Betting promotions or campaigns, and any other bonuses that are permitted in accordance with regulatory enactments.
Software - any software that is a part of the website SPELET.LV and is located on the said website, including any software required for Gambling, as well as the Gambling content (games) itself.
Organizer's Data and Information - any kind of Organizer's information, data and materials (including, but not limited to texts, drawings, graphics, audio and video materials) available to the User on the website SPELET.LV.
Inspectorate - Lotteries and Gambling Supervision Inspectorate [Izložu un azartspēļu uzraudzības inspekcija] of the Republic of Latvia.
Terms and Conditions - the present Terms and Conditions for organizing of interactive gambling and/or the Terms and Conditions (as approved by the Inspectorate) for individual gambling (games) which is offered to the User on the website SPELET.LV.
All elements of the Terms and Conditions (separate headings, sections, subsections and their titles, numbering, terms, etc.) are used for convenience only and may not be used to interpret the text as a whole or in parts. If there are any discrepancies and/or contradictions found between the Terms and Conditions and other documents and/or information referring to the Terms and Conditions, the Terms and Conditions shall prevail. The Organizer is entitled to make amendments to the Terms and Conditions at any time and in the amount (and in the cases specified in regulatory enactments upon receipt of the approval of the Inspectorate) by publishing the current version of the Terms and Conditions on the website of SPELET.LV.
1. GENERAL PROVISIONS
1.1. The Organizer been issued and has received a license issued by the Inspectorate for the organization of interactive gambling in the Republic of Latvia (slot machine games, bingo, roulette, card games, dice games, betting and wagers).
1.2. The Organizer operates in accordance with the effective regulatory enactments of the Republic of Latvia. The compliance of the activities of the Organizer with the effective regulatory enactments is controlled by the Inspectorate.
1.3. The User is aware of the fact that the Gambling offered contains elements of random luck. By placing a Bet, the User may receive a prize or winning that depend in whole or in part on a random luck event or circumstances that are previously unknown.
1.4. The Organizer has the right to declare the Gambling results invalid (void) if the result of Gambling has been affected by technical damage or fraudulent and/or illegal activity of the User. If such correction of the results leads to a negative balance in the Profile's account, the User shall cover the resulting difference by making the required amount of Deposit in his/her Profile balance.
1.5. The Organizer is not responsible for any loss or damage caused to the User as a result of Force Majeure events of circumstances (including, but not limited to, any kind of war or military conflict, fire, flood or other natural disaster), as a result of interruptions in electricity supply, as a result of interruptions in telecommunications services or damage to networks, as a result of acts or omissions of state and/or municipal institutions or third parties, as a result of violation of the Terms and Conditions by the User or non-fulfillment of obligations or liabilities therein, or in the event that the said losses have occurred due to the third party delaying the fulfillment of its obligations or not fulfilling them at all. In any of the cases referred to in the present clause, the Organizer shall be entitled to suspend the provision of services in whole, in part or for a certain period of time.
1.6. The Organizer shall not be held responsible for any losses related to technical errors in the operation of any equipment or Software, which may cause damage to the work of website SPELET.LV, delay the execution of instructions regarding the Bets or their registration, lead to any error in the Gambling programme, or prevent the User from contacting the Organizer.
1.7. The Organizer shall not be held responsible for any loss or damage caused to the User as a result of improper use of the website SPELET.LV. The Organizer is not responsible for the quality of any third party services (e.g., those of the Gambling provider or hosting of the website SPELET.LV), and does not guarantee that the website SPELET.LV and its content will be suitable for all devices and will work without interruption, but it will make every reasonable effort to ensure that the said services are provided without interruption. The User is informed and aware that the Organizer is entitled to declare the result of the Gambling and/or the Winnings of the User invalid (void) if a technical or any other error in the Software has occurred in this particular Gambling (game).
2. USER REGISTRATION
2.1. In order to receive the services provided by the Organizer, the User must create a Profile on his/her own on the website of SPELET.LV. After the end of the registration process, the User Profile will operate until the User closes it independently (on his/her own), or until the Organizer closes it in accordance with the Terms and Conditions.
2.2. Persons under the age of 18 are prohibited from registering and from performing any other activities on the website of SPELET.LV.
2.3. The User may not use the services of the Organizer if he/he does not agree with the Terms and Conditions published on the website of SPELET.LV.
2.4. When registering the Profile, the User must notify the Organizer of the following data:
1) name and surname;
2) date of birth;
3) personal identification number;
4) address of residence and postal code;
5) mobile phone number;
6) data on the current account of a credit institution registered in the Republic of Latvia, from which the User will make a Deposit;
7) other information that will be requested from the User during the registration process.
2.5. The User confirms that all information provided by the User in the registration process on the website of SPELET.LV, as well as the information provided by the User at the request of the Organizer after the registration process (e.g., information on the sources of funds or additional information), is correct, complete and true. The User agrees that the Organizer is entitled to check the User or his/her data at any time while the User's Profile is active. If the User provides false or incomplete information to the Organizer during the registration process, the Organizer is entitled to cancel all Bets made or Winnings received by the User, as well as deactivate, block or close the User's Profile and notify the law enforcement authorities of the detected violation.
2.5.1. In the event of a change in the User's personal data or other information provided by the User, the User is obliged to update the information in his/her Profile. If the User is not able to make such changes independently, he/she must immediately notify the Organizer of such necessary changes by sending the relevant written notice to the Organizer's e-mail.
2.5.2. After registration of the Profile, the Organizer shall be entitled to request additional information from the User in order to prevent unauthorized, illegal or non-compliant use of the Profile.
2.6. By registering on the website of SPELET.LV and using the services offered there, the User confirms the following:
1) The User is a natural person (any legal person or entity will not be accepted as a User);
2) The User is a citizen or a non-citizen inhabitant of Latvia, or a person who has been granted a residence permit in the Republic of Latvia, has a personal identification code of Latvia and is located in the territory of the Republic of Latvia;
The User is informed that the Organizer is entitled to provide services only in the territory of the Republic of Latvia. In order to fulfill the above requirement, the IP address of the User's device used for access to website of SPELET.LV will be checked. In case it is established that the mentioned IP address is not located in the territory of the Republic of Latvia, the User will be denied access to SPELET.LV and will not be entitled to use the Organizer's services.
3) His/her acting capacity is not limited or restricted;
4) He/she does not act in the name or on behalf of a third party;
5) The User is not a person addicted to gambling and is not included in the register of self-reluctant (self-denial) persons held by the Inspectorate;
6) He/she does not use a bank account or payment card that is prohibited to be used in order to receive and/or pay for the Organizer's services;
7) The User Profile will not use funds the origin of which cannot be substantiated or proven, or whose origin is illegal;
8) The User Profile will not be used to directly or indirectly support or promote illegal activity;
9) He/she uses solely and entirely his/her personal data in order to create the Profile;
10) He/she will not use the services of SPELET.LV, its Software and/or the information received from the Organizer for any type of activity that is illegal or prohibited by the Terms and Conditions;
11) By participating in the Gambling, the User is the real beneficiary;
12) The User is fully aware of the possible risks of losing money when playing Gambling and using the services available on the website of SPELET.LV;
13) Funds paid into his/her Profile balance are not/cannot be recognized as income from illegal activities;
14) The User does not engage in any illegal or other prohibited or unauthorized activity and does not intend to use the Profile to do so. The User does not use or allow third parties to use the Profile in connection with any illegal or illegal activity, including but not limited to money laundering or terrorist financing, in accordance with any law or regulation applicable to the User and/or the Organizer.
15) The User is fully responsible for any actions performed on the website of SPELET.LV from the User's Profile;
16) The User will not use the services provided by the Organizer, website SPELET.LV, equipment, Software or other received information in such a way as to negatively affect the Organizer or other Users;
17) The User will not use, download or distribute programs, files, information or data that contain computer viruses that may cause damage or adversely affect the operation of the Software, the Organizer's services or the website of SPELET.LV;
18) The User will not distribute any information that contains illegal, defamatory, pornographic or racist content, or any other material that may provoke or support behaviour or actions which may be classified as a criminal offence, lead to civil liability or otherwise violate the law;
19) The User will use the services of the Organizer only for personal entertainment and not as a business or other activity.
2.7. By registering on the website of SPELET.LV, the User agrees that the Organizer guarantees the non-disclosure of Profile's personal data to third parties in accordance with the requirements of regulatory enactments, except for the cases provided for in regulatory enactments.
2.8. The Organizer processes the User's personal information in accordance with the Organizer's privacy policy, which is published on the website of SPELET.LV.
2.9. After the User has provided the Organizer with all the data and information required for the registration of the Profile, the Organizer shall verify the User within 3 (three) business days at the latest, including the User identification (verification) and age verification. The Organizer shall also check whether the User has not requested to be denied access to the Gambling organized by the Organizer.
2.10. The Organizer has the right to refuse registration to any User or to close any User's Profile without giving reasons for such refusal of registration or closing of the Profile.
2.11. During the registration process, the Organizer shall provide the User the opportunity to choose one of the methods (limits) for determining the maximum Bet for this User – either by setting the maximum amount of Bets that the User can make in one Gambling session (game), or by setting the maximum amount of Bets that the User can make in all Gambling sessions in a 24-hour period.
2.11.1. If the User submits an application to the Organizer to increase the maximum amount of the Bet (or Bets), the Organizer shall increase the mentioned limits after 7 (seven) days from the date of receipt of the application.
2.12. Each User shall use his/her Profile personally without passing on their Profile information or access data to any other person. The User is personally responsible for the confidentiality and security of the profile access data. In case the User does not fulfill the mentioned obligations, the Organizer is not responsible for losses or other consequences if the Profile has been used by third parties.
2.13. If the User has reason to believe that any of his/her Profile data have become known to third parties, the User shall be obliged to immediately change the Profile password and notify the Organizer of his/her suspicions. If the User Profile data have been lost or become known to third parties, the Bets made from this Profile cannot be cancelled or annulled.
2.14. The User has the right to register only one Profile on the website of SPELET.LV. In the event that the User violates this provision, the Organizer has the right to deactivate, block and/or close the additional User Profile/-s. The Profile that was first registered shall be considered to be the basic/original User's Profile.
2.15. If the Organizer becomes aware that the User owns several Profiles or that the User Profile or additional Profile/-s is/are used to increase the maximum Bet, the Organizer shall be entitled to cancel all Bets made by the User and to suspend all Deposits/Withdrawals from this User Profile/-s until the circumstances are fully clarified.
2.16. In case the Organizer becomes aware that the User has registered with SPELET.LV with data of another person, the Organizer shall be entitled to cancel all Bets made by the User, or to deactivate, block or close the User Profile.
2.17. The Organizer shall be entitled to immediately deactivate, block and/or close the User's Profile without separate notice to the User if the User violates any of the Terms and Conditions.
3. PROVISIONS ON PAYMENTS, GAMES AND WINNINGS
3.1. The only currency used on the gambling platform SPELET.LV is the euro (EUR). Use of other currencies on the website SPELET.LV is not possible.
3.2. The User Profile gives the opportunity to participate in Gambling, which is available on the website SPELET.LV. The User must make a Deposit of funds to the balance of his/her Profile using the payment methods indicated on the website SPELET.LV. The Organizer has the right to change the available payment methods at its own discretion. The Organizer does not guarantee that all payment methods will be available at any time.
3.3. The User has the right to use only those current accounts and payment cards registered in his/her name. The User shall not be entitled to use current accounts and payment cards opened, registered and / or issued in the name of third parties. If it is established that a third party current account and/or payment cards are used, the Organizer shall be entitled to notify the law enforcement authorities, suspend funds in the balance of the User's Profile, and to deactivate or block the User's Profile until the circumstances are fully clarified.
3.4. The Organizer manages all amounts of money transferred to the Profile's balance free of charge as a User's representative (as long as the Profile is active) and without paying interest on holding such funds. The Organizer is not a financial institution and the User has no right to claim or receive interest on the balance of the Profile.
3.5. After the Deposit has been contributed, the Organizer performs the necessary verifications. The time of depositing the Deposit in the Profile balance depends on the payment method as is selected by the User. As soon as the Deposit has been credited to the Organizer's account, the User's Profile balance is immediately replenished by the Deposit amount. The Organizer has the right not to accept the Deposit from the User at any time and at its own discretion, without explaining the reasons for non-acceptance.
3.5.1. It is illegal to transfer illegally received/acquired funds to the Profile balance. If the Organizer suspects that income from illegal activity has been credited to the Profile balance, the Organizer informs law enforcement authorities, as a result of which funds in the Profile balance may be withheld, but the Profile may be deactivated or blocked.
3.5.2. In case any amount was erroneously credited to the User's Profile balance, the User is obliged to inform the Organizer immediately (within 24 hours from the moment of finding/determining the error). Any amounts erroneously credited to the User's Profile balance are deemed as illegally received by the User, and if there are sufficient funds in the User's Profile balance, the Organizer shall deduct the said amount from the Profile balance. If there is insufficient amount of funds in the User's Profile balance, the User shall be obliged to immediately replenish his/her Profile balance by reimbursing to the Organizer an amount equal to the amount erroneously credited. The amount received in error cannot be used to make Bets. The Organizer shall be entitled to cancel all Bets and/or transactions made with erroneously credited amounts.
3.5.3. The User guarantees that he/she will not withdraw or cancel the Deposit, or carry out any other action related to the cancellation of transactions to replenish the User's Profile balance. If the Organizer finds that the User performs any of the actions referred to in the present clause, the User shall indemnify the Organizer for all losses incurred as a result of such actions of the User.
3.6. The minimum and maximum Deposit amount is indicated next to each of the payment methods. The Organizer is entitled to change the minimum and maximum amount of the Deposit at any time at its own discretion.
3.7. The User deposits money into the Profile balance for the purpose of participating in the Gambling. If the User does not make any Bets, the Organizer is entitled to temporarily deactivate the User's Profile in order to assess whether the transaction complies with the signs of an atypical or suspicious transaction or not.
3.8. The User can participate in Gambling by making a Bet. The amount of Bet shall be determined by the rules of each individual game. The User may not make a Bet in an amount higher than the funds available in the Profile's Balance. The Organizer does not accept the User's Bet if the User does not have sufficient funds to make such a Bet.
3.8.1. If an error occurs regarding the website SPELET.LV or any of the Bets, all relevant Bets will be cancelled. In case of an error in the system of SPELET.LV, the Organizer is entitled to cancel all the Bets.
3.9. Winnings are credited to the User's Profile balance.
3.10. The Organizer may make special offers available to the User. The terms and conditions of the said special offers are published on the Organizer's website SPELET.LV. The Organizer is entitled to change both the special offers and the Terms and Conditions at any time.
3.11. The Organizer has the right to cancel the Gambling results or declare them invalid (annulled) if the Gambling result has been affected by a technical failure or fraudulent or illegal actions of the User and/or third parties. The existence of a technical failure is determined by a separate opinion of the Organizer or the provider of the particular Gambling (game), such opinion is final, and the User has no right to contest/appeal such opinion.
3.12. Winnings are paid out in accordance with the procedures specified in regulatory enactments:
1) Winnings up to EUR 720 are paid out immediately;
2) Winnings in the amount from EUR 720.01 to EUR 14300 are paid out within one business day;
3) Winnings in the amount of over EUR 14300 are paid out not later than within 30 days, and in no more than 2 (two) payments.
3.13. Withdrawal/payout of money from the User's balance is made upon the User's request. The requested withdrawal/payout amount may not be less than 10 (ten) EUR. Withdrawal/payout can be made only to the current account registered in the User's name, from which the Deposit was made to make the Bet. No withdrawal/payout can be made to the current account of another User or a third party. The User is responsible for the correctness and accuracy of the information provided, and in the event that the User has provided inaccurate information and a Withdrawal has been made on the basis of this inaccurate information, the User shall not be entitled to submit any claims or requests to the Organizer.
3.13.1. Fee of the financial institution for making the Deposit shall be covered by the User. On the website of SPELET.LV, the Organizer shall indicate the amount of the commission for the disbursement/withdrawal of funds, if such a commission is applied, in relation to each of the payment methods. In a situation when the User makes a Deposit and, without making a Bet, makes a request to make a Withdrawal to the current account or payment card of his/her financial institution, the Organizer shall be entitled to apply a commission fee of 10% of the Withdrawal amount to cover payment processing costs.
3.13.2. The User has the right to request a Withdrawal from his/her Profile balance no more than 4 (four) times a day (within a period of 24 hours).
3.14. The Organizer shall process the request for Withdrawals from the Profile balance within 3 (three) business days. Provided that all the necessary checks have been performed, the Winnings will be paid out within the time limits specified in Clause 3.12 of Terms and Conditions.
3.14.1 The Organizer has the right to cancel (reject) the withdrawal request, if it is requested more than 18 days ago, and still hasn’t been paid out.
3.15. According to the Law “On Personal Income Tax” ["Par iedzīvotāju ienākuma nodokli"], the Organizer shall be obliged to deduct tax from any Winnings exceeding EUR 3,000, which are calculated for the User at any one time or in total during the whole visit to the gambling venue, or calculated in a form of related transactions. For the part of the Winnings that exceeds EUR 3,000, but does not exceed the maximum amount of the object of mandatory contributions specified in accordance with the Law "On State Social Insurance" ["Par valsts sociālo apdrošināšanu"], a tax rate of 23 percent shall be applied, whereas for the part of the winnings of lotteries or gambling that exceeds the maximum amount of the object of mandatory contributions specified in accordance with the Law "On State Social Insurance", a tax rate of 31 per cent shall be applied.
3.15.1. Related transactions include, for example, multiple Withdrawal requests in a single day, Withdrawal requests in several installments, and other transactions that meet the characteristics of related transactions.
3.15.2. If the amount of the User’s yearly gambling winnings exceeds 3000 EUR, the User is obliged to independently (on his/her own) submit an annual income declaration, declaring his/her taxable income and, if necessary, paying the calculated tax amount in accordance with the requirements of regulatory enactments. 3.16. The Organizer has the right to check the User's right to receive the Withdrawal and in case of reasonable doubt to suspend the payment. The Organizer shall be entitled to request the User to submit any additional information or documents. The personal data of the User (who owns the Profile) and the personal data of the bank account holder must match.
3.17. The Organizer has the right to refuse the disbursement/withdrawal of funds to the current account or payment card of the User's selected financial institution, or to refuse to credit (deposit) funds to the Profile balance in the following events:
1) If the User credits money from a third party current account or payment card;
2) If the User requests a Payment to the current account of another person's financial institution;
3) If the amount to be paid in (credited) or paid out (withdrawn) exceeds the limits specified in the relevant section of the Terms or Conditions, or website SPELET.LV, or
4) If the amount indicated for replenishing the Profile balance differs from the actual transfer amount.
3.18. With the objective to prevent money laundering, the Organizer checks and verifies all transactions with the Profile account and/or funds in order to ensure that the transactions are not considered unusual or suspicious. The Organizer has the right to refrain from performing unusual or suspicious transactions and to report such transactions to the relevant supervisory authorities in accordance with the procedures specified in regulatory enactments. In case of reasonable suspicion, the Organizer shall be entitled to deactivate, block or close the respective User's Profile and withhold the funds in the balance of this Profile.
3.19. In order to ensure the identification of the User and the supervision of the operations performed by the User, the Organizer in accordance with the requirements of the Law on the Prevention of Money Laundering and Terrorist and Proliferation Financing [Noziedzīgi iegūtu līdzekļu legalizācijas un terorisma un proliferācijas finansēšanas novēršanas likums] (hereinafter also referred to as PMLTPF), shall be obliged to register all the User's operations, the amount of which in one payment or several related payments in a 24-hour period is EUR 2,000 or more.
3.20. Upon the respective request of the Organizer, the User is obliged to submit additional documents and/or information related to the User's activities with his/her Profile, as well as to provide answers to the questions stipulated by PMLTPF, which are necessary for the User's research.
4. RIGHTS AND LIABILITIES
4.1. It is strictly forbidden to place Bets or participate in Gambling on behalf of others. The Organizer has the right to cancel all Bets and Winnings received on behalf of third parties and to deactivate/close the Profile of the User who violates the said ban.
4.2. If the Organizer has reasonable suspicions that the User violates any of the Regulations or the laws and regulations of the Republic of Latvia, or if there is a reasonable suspicion that the User's actions may be qualified as fraud within the meaning of the Criminal Law [Krimināllikums], the Organizer is entitled to no longer accept Bets from this User, but if necessary or at the request of the controlling/supervising authorities – also to deactivate, block or close the User Profile.
4.3. The Organizer is entitled to request information and/or documents from the User at any time in order to confirm the following:
4.3.1. User's personal identification;
4.3.2. User's right to use the bank account or bank card specified in the Profile;
4.3.3. the accuracy and timeliness of the information provided by the User at an earlier point.
4.4. The Organizer, at its discretion, checks and classifies all User Profiles. Upon discovery of Users who fall into the "bonus hunter" category or who abuse the special offers, all Winnings and/or bonuses of these Users will be cancelled and void.
4.5. The Organizer manages the funds in the User Profile balance in accordance with the general funds management rules, which include, inter alia, rules on the transfer of funds to supervisory authorities, financial institutions and/or payment service providers (upon request).
4.6. The Organizer is entitled to freeze funds in the User's Profile balance if the User engages in fraudulent activities, or in the case the Organizer determines that the User has used the system (including any mechanisms, robots, bots, computers, software or any other automated system) with the intent to bypass the Software used by the Organizer and/or the internet browser used in order to illegally, unfairly or in a prohibited manner receive the services rendered by the Organizer.
4.7. The Organizer is entitled to refuse to pay out the funds not used for receiving the Organizer's service, or delay such disbursement until the origin of such funds has been verified, and until the compliance of the User's activities with the Terms and Conditions and regulatory enactments is verified.
4.8. The Organizer undertakes the following:
4.8.1. to properly manage the funds in the User's Profile balance in accordance with the Terms and Conditions and regulatory enactments;
4.8.2. to process the User's data in accordance with the applicable regulatory enactments.
4.9. The Organizer has the right to suspend the use of the Profile at any time, deactivate or block the Profile, as well as cancel any Bets and/or Winnings, suspend or terminate any activities of the User on the website SPELET.LV, freeze all funds in the User Profile balance or refuse any Withdrawal if the Organizer has a reason to believe any of the following:
1) The User or persons living at the same address as the User have more than one Profile on the website SPELET.LV;
2) The data and information provided by the User during the registration at the website SPELET.LV do not correspond to the data of the payment card used to make the Deposit;
3) The User has provided false information during the registration process;
4) The User has not submitted data and/or information requested by the Organizer;
5) The User makes the Deposit with funds obtained illegally or by illegal methods;
6) The User has committed or attempted to commit fraudulent activities;
7) The User has received the Winnings in one of the Gambling sessions (games) as a result of a technical failure of the Software, and such technical failure has been recorded by the Organizer and/or the Gambling Provider;
8) The User has made it possible (intentionally or negligently) to use his/her Profile to third parties;
9) The User has violated any of the Terms and Conditions.
4.10. The Organizer is entitled to add new Betting or special offers, games or features on the website SPELET.LV at its own discretion, and create, delete, suspend or restrict access to any Betting or special offer, Gambling or feature on the said website at any time.
4.11. The User has no right to change, transfer or notify the Terms and Conditions or any part thereof to third parties.
4.12. The Organizer is entitled to suspend the work of website SPELET.LV for the performance of technical maintenance work in full or in part at any time, and in this case the Organizer shall not be liable to the User for any inconvenience, loss or damage. In case the mentioned technical maintenance works are planned, the Organizer will announce the planned time of the mentioned works on the website SPELET.LV in time. The obligation to give prior notice does not apply to unforeseen accidents and/or technical damage.
4.13. In order to comply with the security system requirements of a certain payment solution provider or a financial institution selected, the Organizer is entitled to refuse to accept any Deposit in whole or in part. These security requirements may lead to the rejection of legitimate payment cards if they cannot be processed at that particular time.
4.14. The User has no right to abuse the technical errors or deficiencies found on the website SPELET.LV, in any of the Organizer's Software or the User's application contrary to the Organizer's interests, Terms and Conditions or rules of the individual Gambling modes (games). If the User finds the following technical error or defect, he/she shall be obliged:
1) to refrain from receiving any benefits/bonuses;
2) not to disclose to third parties information about the detected error or deficiency;
3) to immediately notify the Organizer of the detected error or deficiency by sending an e-mail to the Organizer's e-mail [email protected].
4.14.1. Notwithstanding the legal remedies offered by regulatory enactments, if the User does not comply with the requirements referred to in Clause 4.14, the Organizer shall be entitled:
1) to request from the User compensation for the damage caused to the Organizer for non-fulfillment of the obligations specified in Clause 4.14;
2) in particular, but not limited to, to block the relevant User Profile, cancel the results of any Gambling and any Winnings, to suspend and/or confiscate the funds in the User's Profile balance in full or in part without prior notice in order to cover in full or in part the losses caused to the Organizer.
4.15. The User shall be obliged to independently get acquainted with the regulatory enactments that regulate interactive gambling in the territory of the User's country of residence and to comply with the said acts.
4.15.1. If interactive gambling is prohibited in the territory of the User's country of residence, the User shall not be entitled to use the means of payment specified by SPELET.LV for concluding any transactions with the Organizer.
4.16. The Organizer shall terminate any cooperation with a User who has been subject to national or international sanctions (the User is included in any list of sanctions).
5. INTELLECTUAL PROPERTY
5.1. Information, materials and data, including but not limited to marketing materials, texts, graphics, video and audio content, software and other data (including Organizer data), which are available to the User on the website of SPELET.LV (hereinafter also referred to as the Data) are owned by the Organizer or persons to be specified by the Organizer. The Data and Software indicated above are for your personal and non-commercial use only.
5.2. The User shall not be entitled to copy, modify, reproduce, store, distribute, display, perform or include in any media program, publish, transfer, sell, lease, authorize to rent, grant licenses of any kind for use or otherwise use the Data or transfer them or any part thereof to any third party, as well as record the Data on any data carriers or devices, except for the cases provided for in regulatory enactments.
5.3. The Software, services and Data available on SPELET.LV are protected by copyright, trademarks and other forms of intellectual property. All rights, names and interests in the Software, services and information on the said website are owned, leased to and/or controlled by the Organizer or its affiliates. The User agrees and acknowledges that the User does not acquire any rights or licenses to the Software, Services and Data when using the website of SPELET.LV.
6. RULES OF RESPONSIBLE GAME
6.1. A person who has a Gambling problem may not take part in Gambling or register a User Profile. If, after registering the Profile, the User has established that he/she has a Gambling problem, the User must immediately seek assistance and help.
6.2. By submitting a respective application to the Organizer, the User has the right to request that he/she be prohibited from playing the Gambling offered on the Organizer's website SPELET.LV, and that an appropriate note be made in the Register of Users established and maintained by the Organizer. The User may withdraw the application referred to in this clause not earlier than after 12 months from the date of submission of the application.
6.3. The User has the opportunity to centrally deny him/herself access to all gambling events organized in the territory of the Republic of Latvia, by including information about him/herself in the register of self-reluctant (self-denial) persons of gambling and interactive lotteries. The User may personally include information about him/herself in the said register by submitting a relevant application to the Organizer or to the Inspectorate, remotely, using electronic means of identification, or by clicking on the following link: https://registrs.iaui.gov.lv/. The User is entitled not earlier than after 12 (twelve) months, when submitting the respective application to the Inspectorate, to request the exclusion of him/her from the register of self-reluctant (self-denial) persons.
6.4. A User who has submitted a request to the Organizer to deny access to the Gambling offered on the website SPELET.LV, or who is registered in the in the register of self-reluctant (self-denial) persons of gambling and interactive lotteries, cannot access his/her User Profile during the operation of these restrictions.
6.5. All Bets made by the User until he/she has requested to be prohibited from playing the Gambling offered on the Organizer's website SPELET.LV, or until he/she is included in the register of self-reluctant (self-denial) persons, shall remain valid. The Organizer is not responsible for any losses that the User may incur after his/her inclusion in the register of self-reluctant (self-denial) persons.

7. LEGAL DISCLAIMER
7.1. If the website SPELET.LV contains links to third party websites for advertising purposes, the Organizer is not responsible for the content of these sites. The organizer makes no warranties regarding third party websites and/or any goods, services, or their privacy policies, advertising, sales or other features available on these websites. The Organizer shall not be liable in any way for any loss or damage arising out of or in any way connected with the use of third party websites.
7.2. The circumstance that the Organizer is unable to fulfill any part of its obligations specified in the Terms and Conditions does not in any way release the User from the full performance of his/her obligations.
7.3. If any part of the Terms and Conditions becomes or is declared invalid, illegal or inapplicable by a court, such part shall be excluded from the current version of the Terms and Conditions, but the remaining Terms and Conditions shall remain in full force and effect.
7.4. The User is informed and agrees that the User's access to the services, the website SPELET.LV, the Software and other data of the Organizer, as well as the interpretation of the Terms and Conditions is regulated by the laws and regulations of the Republic of Latvia.
7.5. The Organizer is not responsible for any downtime and/or server malfunctions, interruptions or other technical failures on the website SPELET.LV.
7.6. The Organizer shall not be liable for any damage or loss caused by the website of SPELET.LV or its content, including, but not limited to, delays or interruptions in operations or functionality, loss of network communications or any other error. The Organizer reserves the right to cancel all bets and Winnings affected by such delay or other error and to take any action deemed necessary by the Organizer to correct or eliminate such delay or error.
7.7. The User is informed and agrees that in the event of damage or technical error within the website SPELET.LV, the Software or any Gambling system, all Bets will be cancelled ad void.
7.8. The User uses the services provided by the Organizer at his/her own discretion and free choice, fully assessing the existing risks. The User acknowledges and understands that the services offered on the Organizer's website of SPELET.LV are for entertainment purposes only and should be used for entertainment purposes only. The User is prohibited from using the services offered by the Organizer for any other purposes.
7.9. When using the Organizer's services on the website SPELET.LV, the User is informed, aware of and accepts certain internet risks and restrictions, in particular the following: technical capabilities, response time, information requirements, risk of loss of communication and general risk of any connection and data transmission failures.
7.10. The SMS notification service, if provided, is for the convenience of the User only. The Organizer does not acknowledge and does not bear any responsibility in case an error occurs in the content of the SMS-notification or if the User does not receive the SMS-notification.
7.11. The User is not entitled to claim compensation from the Organizer, its employees or partners for any damages, expenses, losses or other claims (including litigation costs), if such damages, expenses, loss or claims are due to User's negligence, downloads, installation, use or technical error of the Software, or due to the fact that the User misused the obtained information or violated the Terms.
7.12. In no event shall the Organizer be liable for any loss, damage, or injury, including any disruption or damage to the User's device or data, or related to the User's access to the Organizer's services, website of SPELET.LV, the Software and/or other information.
7.13. Website SPELET.LV and the Software are offered "as is", that is, in the form, condition and specification in which they are available to the User. The Organizer does not guarantee that the Services, Software, SPELET.LV or other information provided will be accurate, complete, current, error-free, free of defects or any disturbances, or that unknown defects will be corrected.
7.14. The Organizer, to the best of its ability, applies preventive measures to protect the provided services, Software and SPELET.LV servers from computer viruses, from spyware, adware, or other malicious, destructive, or malicious code, programs, malware, data, or any other features which may affect any device or data in it. However, the Organizer does not guarantee that the services will not contain any of the above threats. The User independently takes precautions to protect him/herself from malicious interference or damage to his data and/or devices.
7.15. If a court or an equivalent institution, which has competence and/or jurisdiction in relation to the Organizer, establishes the Civil Liability of the Organizer towards the User, the amount of such liability will in any case not exceed the lesser sum of the following two amounts: total amount of the Bets made by the User or the amounts of Winnings.
7.16. The Organizer does not provide the User with legal or tax advice. If the User wishes to receive any of the above consultations, the User shall contact the relevant consultants and/or service providers.
8. SETTLEMENT OF CONFLICTS
8.1. Any disputes between the User and the Organizer shall be resolved through communication and negotiation based on the Terms and Conditions.
8.2. If the User has any questions about the website SPELET.LV or the services provided by the Organizer, or if the User suspects a technical or other type of error in the provision of services, the User shall make use of the Organizer's customer support by sending an e-mail to the Organizer via [email protected], or by contacting via the “live chat” feature on the website SPELET.LV.
8.3. The User may submit a complaint or claim to the Organizer in writing within 15 days from the date of the situation by sending such a complaint or claim to the address Terbatas street 73, Riga. The Organizer shall review the complaint or claim and provide a written response to the User within 15 business days from the date of receipt of the respective message/communication. The User may also send the said complaint or claim to the Organizer electronically, by signing it with a secure electronic signature and sending it to an e-mail address [email protected].
8.4. If settlement of the respective dispute or issue has proven impossible in accordance with Clauses 8.1., 8.2., and/or 8.3. of the Terms and Conditions, the User and the Organizer shall resolve it in accordance with the laws and regulations of the Republic of Latvia in a Latvian court of a general jurisdiction.
9. INACTIVE PROFILES AND CLOSING THEREOF
9.1. An Inactive User Profile is a User Profile in which no activity (log-in and/or log-out) has been detected in the last 12 (twelve) months.
9.2. The Organizer shall be entitled to apply a monthly fee of 5 (five) euros for the administration of an Inactive User Profile, and such fee shall be deducted from the balance of an Inactive User Profile starting from the month following the month in which the User Profile was recognized as an Inactive User Profile.
9.3. The Organizer is entitled to close an Inactive User Profile when its balance is 0.00 euros. A warning shall be sent to the User 30 (thirty) days before any charges are deducted from the Profile balance. The alert allows the User to renew or update his/her Profile by logging into it. In the event that the User renews his/her Profile within 3 (three) months from the date of sending the notice, all funds withheld due to the administration of the Inactive User's Profile will be returned to the User.
9.4. The User can request the closure of his/her Profile. Prior to such action, the User shall be obliged to disburse all funds in the Profile balance in accordance with the requirements of the Terms and Conditions.
9.5. The Organizer shall be entitled to close the User Profile in case the User violates any of the Terms and Conditions or applicable laws and regulations with his/her actions or omissions.
